© 2017, Springer-Verlag Berlin Heidelberg.The article gives an overview on insurance contract law comparing system and specifics of Turkish and German law. It is based on presentations the authors held in Berlin at a German-Turkish symposium hosted by the German association of insurance science (Deutscher Verein für Versicherungswissenschaft), in 2015. The authors structure the article by focusing on insurance contract law specific topics in each case firstly outlining Turkish law and secondly German law. In detail, the article points out the differences and similarities with respect to the conclusion of insurance contracts, information duties of the insurer, the existence of rights of the policyholder to “cancel” the contract after its conclusion, premium payment, proscription of enrichment etc. One of the main emphasizes lies upon the abandonment of the “all-or-nothing-principle” (Alles-oder-nichts-Prinzip) and its replacement. The article, thereby, aims to promote the jurisprudential exchange between the different legal systems.
